The following Membership Terms & Conditions take effect on March 1, 2025, for new Members or any Associate/Dependent Associate Member added on or after March 1, 2025. For renewing Members, these updated Membership Terms & Conditions will apply to you upon your first Membership renewal on or after March 1, 2025.

Membership Terms & Conditions

As a AAA Northern California, Nevada & Utah, AAA Arizona, Inc., AAA Mountain West, Inc. (collectively, “AAA”) member (each, a “Member” or collectively, “Members”), you are subject to these Membership Terms and Conditions, the Website Terms and Conditions, found here, and any other terms, conditions, or agreements governing your use of AAA products or services, as applicable, all of which are incorporated herein by reference. In the event of a conflict between the Membership Terms and Conditions on the one hand and any other terms, conditions, or agreements on the other hand, the Membership Terms and Conditions shall govern solely with regard to the transactions contemplated herein.

We may amend these Membership Terms and Conditions from time to time, by posting the amended Membership Terms and Conditions on this page. We may also post a prominent notice of material changes to these Membership Terms and Conditions on the home page of the AAA website. Any changes to these Membership Terms and Conditions will be effective immediately for new Members; otherwise these changes will be effective upon thirty (30) calendar days following our posting of a notice on our Site. Accordingly, you should check this page regularly for any updates to these Membership Terms and Conditions. Continued possession or use of your Membership following notice of such changes shall indicate your acknowledgment of, and agreement to be bound by, such changes. Except as provided in this Section, no amendment to these Membership Terms and Conditions will be valid.

AAA Emergency Road Service Coverage

AAA Emergency Road Service is an exclusive benefit provided to AAA Members. It is designed to get Members back on the road as quickly as possible. Members must provide a valid Membership card and matching photo identification for all Emergency Road Services.

AAA membership (“Membership”) provides each Member up to an aggregate of four (4) total Emergency Road Services per Membership year, which includes disabled bicycle transportation service (see additional terms and conditions below).

AAA Emergency Road Service coverage includes the following services:

Mobile Battery Service

For vehicles that will not start, AAA road service technicians may provide certain battery services, such as testing of the battery or the vehicle, starting and charging systems, or attempting to jump-start the battery. Members may purchase a AAA-branded battery, which the technician will install for the Member (some labor-intensive installations may require additional charges). Due to safety concerns, the installation may be at a nearby location rather than the original service site. Service hours and battery availability varies by location. Battery charging is not covered by AAA Emergency Road Service.

Tire Change

AAA road service technicians will assist Members in installing spare tires. If an inflated spare is not available or the existing spare is deemed unsafe by the technician, the Member may elect to have the vehicle towed (subject to the towing terms and conditions below). Tire repair is not covered by AAA Emergency Road Service.

Fuel Delivery

AAA road service technicians will provide free delivery of enough fuel to get the Member to the nearest service station. Requests for diesel fuel must be made during a Member’s call for service; diesel may not be available in all locations. AAA Classic Members will be charged for fuel at the market rate. AAA Plus®, AAA Plus® RV and AAA Premier® Members will receive fuel at no charge.

Bicycle Tow

AAA also provides disabled bicycle transportation service to all Membership levels. Bicycle coverage applies to the bicycle ridden by the Member at the time the bicycle becomes disabled. Benefits for bicycle service do not include:

  • Reimbursement for impounding ordered by the police or other authority due to a violation of a law or regulation.
  • Servicing bicycles located in areas deemed not safely passable, including bicycles located off normally traveled roads or streets.
  • Service to unattended bicycles.
  • Storage or repair costs.
  • More than one transportation per disablement.
  • Cost of providing alternate transportation.
  • Servicing due to bicycle rider’s fatigue and physical inability to continue, provided that exceptions may apply in instances of an injury resulting from an accident.
  • Rendering mechanical first aid or changing a flat tire.
  • Rendering service to break or cut a lock on a secured bicycle.

Lockout/Locksmith Service

AAA service technicians are available to provide lockout services for Member vehicles. If the technician is unable to open the vehicle or the Member has lost or broken the key, the Member may elect to have the vehicle towed (subject to the towing terms and conditions). Members are covered for locksmith service reimbursement for parts and labor as detailed below.

  • AAA Classic Members are entitled to locksmith reimbursement for vehicles only up to $50 for parts and labor.
  • AAA Plus and AAA Plus RV Members are entitled to locksmith reimbursement for vehicles only up to $100 for parts and labor.
  • AAA Premier Members are also entitled to locksmith reimbursement for vehicles and Home Lockout Service* up to $150 for parts and labor.

* AAA Premier Members are also entitled to Home Lockout Service. Home Lockout Service is available only for the residence on file for the primary AAA Premier Member and applies only to locks that provide access in and out of such residence. AAA will not reimburse for Home Lockout Service if it is used to change locks for any reason other than lost keys (including but not limited to domestic disputes and security concerns).

Vehicle Assessment Services

AAA roadside technicians may also perform checks of connections and fluids and other vehicle assessments. Any services are provided “as is” without any warranty, guarantee or representation, express or implied, of any kind, and may be temporary in nature. Members should have all vehicles inspected and serviced properly.

Towing 

If a Member’s vehicle cannot be started or driven safely, AAA may provide tow services to a destination as described below. There is a limit of one tow per breakdown incident.

*The one tow for up to 200 miles is limited to one tow per Membership year per household.

AAA may use independent contract stations (“ICS”) to provide Emergency Road Service to our Members.

Members will be responsible for the payment of additional costs and expenses of tows that are in excess of the distances or allotments specified above. These will be charged at the then-current rates of the ICS for that area and must be paid to the ICS at the time of service.

Tow services include tows to the nearest repair facility or the responding ICS’s repair facility (if applicable) to the extent such facility is located within the allotted mileage range.

Winching/Extrication

AAA roadside technicians may perform winching/extrication services on a Member’s vehicle, but only if the vehicle can be safely reached from a reasonable distance (as determined in the discretion of the technician) from a passable, normally traveled road or established thoroughfare, and serviced with the equipment ordinarily used for Emergency Road Services. The AAA roadside technician will assess whether a vehicle will be eligible for winching/extrication. If winching/extrication requires special equipment, more than one truck or additional personnel, the Member may be required to pay for such associated costs.

Repair Facilities

If a Member’s vehicle is not operable after the services rendered by a AAA road service technician, AAA may assist the Member in locating a nearby repair facility, which may include:

  • AAA-Owned Auto Repair Centers - which are full-service AAA owned and operated Auto Repair Centers
  • AAA Approved Auto Repair (AAR) facilities - which are repair shops that have been inspected and certified by AAA

Additional AAA Premier Membership Benefits

In addition to the AAA Emergency Road Service benefits described above, AAA Premier Members are further entitled to:

  • Auto Repair Hotline​: AAA Premier Members have access to a hotline for advice on auto repairs, second opinions on repair estimates and referrals to repair facilities. Premier Members can access the hotline by calling the Member Services number on the back of their card and picking Member Services. Hours of operation may vary; please call for more information.
  • Complimentary Car Rental for Towed Vehicles​: AAA Premier provides one free day of car rental (up to a full-size vehicle) in conjunction with a non-collision tow. Fuel and service charges are at Member’s expense. Some restrictions may apply. This benefit is available only if a AAA Premier Member calls the dedicated phone number listed on the AAA Premier Membership card; this benefit cannot be accessed through the rental car company directly. Car rentals are subject to certain terms and conditions of the rental car company. The car must be rented within 48 hours of the tow service, and the rented car must be returned to the location of initial rental. The AAA Premier Member will be responsible for paying any additional charges to the rental car company, including additional rental days not covered by this benefit or any one-way rental. Taxes, fees and optional service charges, such as refueling, are not subject to discount and are the responsibility of the AAA Premier Member. Coupons or other promotions may not apply. Rentals are available at participating locations in the United States or Canada.

AAA Emergency Road Service – Additional Terms and Conditions

The Membership must be active and the Member must be current on dues and any other fees owed. The Member must be present at the time of service, with a valid Membership card and matching photo identification to be eligible for AAA Emergency Road Services. Members without proof of Membership or identification will not be eligible for AAA Road Service and will be financially responsible for service.

Certain restrictions apply to all services, including the availability of services in all locations. Unless as otherwise specified, the terms and conditions apply to each Membership year.

Safety of Members and AAA road service technicians is important to AAA. The technician may assess the situation for safety, which may impact how or if certain services will be available for each situation. AAA reserves the right to provide only such services as is deemed safe and within the normal course of servicing, including but not limited to using ordinary servicing equipment and servicing vehicles that have not been loaded, altered from their original manufacture or custom manufactured in a manner that interferes with the safe and legal rendering of service.

AAA Emergency Road Service is provided to help our Members get back on the road. All vehicles to be serviced must be registered for highway or street use to be eligible for services. Vehicles that are untagged, or not otherwise legally drivable (other than vehicles involved in an accident that renders it un-drivable) will not be eligible for services. AAA Emergency Road Service will not be rendered if services are used as a substitute for regular maintenance. Tows will not be provided for moving a vehicle from one residence to another (unless directly related to the repair of such vehicle) or from a road to a driveway. Fuel delivery is available only for vehicles that are out of fuel. Vehicles will not be towed to/from a salvage yard. Service will not be provided for the purpose of transporting vehicles in connection with a purchase, sale, auction, car show exhibition, donation, or relocation or similar situation. Dismantled, stored or abandoned vehicles or those purchased in an inoperable condition will not be eligible for service. Tows are provided from impound lots provided that the Member’s car is unable to be driven and otherwise fit for towing, and the Member pays all impound fees.

In the event the vehicle is being serviced due to an accident, the Member is required to follow all local, state and federal laws for reporting of the accident prior to service being rendered.

Additionally, services are not provided to: unattended vehicles, unless the Member is unable to remain with the vehicle due to injury or safety reasons; vehicles that are on inaccessible or barricaded areas (including but not limited to yards, beaches, fields); or vehicles unlawfully driven beyond chain controls areas or other areas that is dangerous or inadvisable for travel. Also, there may be “force majeure” events that may directly or indirectly delay, hinder or prevent AAA or an ICS from performing services for our Members. We shall not be liable or responsible to you, nor be deemed to have defaulted under or breached these Membership Terms and Conditions, for any failure or delay in fulfilling or performing any term herein, when and to the extent such failure or delay is caused by or results from the following force majeure events (“Force Majeure Events”): (a) acts of God; (b) flood, fire, earthquake or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of these Membership Terms and Conditions; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; (i) shortage of adequate power or transportation facilities; (j) pandemics, and (k) other similar events beyond our reasonable control. AAA is not obligated to perform services in the event of such force majeure event.

Members are responsible for any fees for services that are not covered by the stated coverages under the Membership; ICSs may provide such services on a fee-for-service basis. For certain covered services, Members may need to pay the technician (at the time of service) and submit for reimbursement. Forms of accepted payment may differ depending on the ICS, which may include limits on the amounts for a personal check.

AAA reserves the right to seek reimbursement, including any reasonable administrative or processing fees, from Members for any services provided for which the Member was not eligible or entitled, or for which Member was obligated to pay at time of service, including non-sufficient funds (NSF) checks.

While AAA and the ICSs strive to provide prompt and efficient service at all times, note that:

  • Delays are sometimes unavoidable due to weather, traffic or road conditions, availability, or unusual service demands. Additionally, longer-distance tows, after hours service requests, and service requests in certain areas may be subject to longer delays.
  • AAA cannot and does not guarantee any response times, and will not be liable for any occurrence that arises during any such delay.Although AAA holds its ICSs to high standards of service, AAA cannot control the availability of the ICS and/or the manner in which independent ICSs render services. AAA will not be liable for their misconduct, negligence or other acts or omissions. AAA will attempt to resolve any Members' vehicle repair and damage complaints resulting from Emergency Road Service provided by our ICSs. Member complaints should be reported as soon as possible and before additional repairs are made. Failure to do so may impair or otherwise limit our ability to assist.
  • It is up to the Member to assure that they remain in a safe location while waiting for a service vehicle. AAA cannot and does not monitor road, traffic or other conditions that may impact your safety, and which may vary and change. If you advise us of any safety concerns at the time of your call for service, we will offer you the option of having the California Highway Patrol or other appropriate law enforcement entity be dispatched to your location. AAA will not be liable for any occurrence as a result of any road, traffic or other conditions that contribute to or otherwise impact service times, or any occurrence resulting from the negligence of any third parties. If at any time you feel that conditions are such that you feel your safety is impaired while waiting for service, please immediately call 911.

When calling AAA Emergency Road Service, a Member will be provided the option to opt-in to allow AAA to identify the Member’s location for purposes of dispatching services. To understand more about our privacy practices, please review our privacy policy.

Emergency Road Service Truck Service

AAA Classic Members are eligible for Emergency Road Service from one truck. If the AAA road service technician determines additional equipment is required before or while providing service, the Member will be responsible for the expense of the second truck or additional equipment.

AAA Plus, AAA Plus RV and AAA Premier Members are eligible for Emergency Road Service for up to two trucks without additional cost to the Member.

Vehicle Eligibility for All Emergency Road Services

Commercial vehicles are not eligible for AAA Emergency Road Service including, but not limited to the following:

  • Vehicles registered to a partnership, corporation, company, commercial entity, or used for commercial purposes
  • Taxicabs, limousines, shuttles and vehicles used for fee-based car or ride sharing (excluding passenger vehicles being rented by a Member for the Member’s personal use) and other vehicles for hire
  • Box trucks, box vans, cube vans, van or truck cutaway
  • Commercially configured vehicles, flatbeds, landscaping vehicles, school buses (including RV conversions)

AAA Classic and Plus Members:​

Certain four-wheeled motor-driven vehicles of the passenger type may be eligible for services, subject to standard servicing restrictions. Dual-wheel campers and motorhomes may be eligible only for lockout/locksmith and fuel delivery services.

AAA Classic Members:

Tent and camping trailers; fifth-wheeled trailers; boat and jet ski trailers; horse and livestock trailers; car, ATV and snowmobile trailers; utility and non-recreational trailers may be eligible for tow services, provided that the Member will be required to pay the ICS directly at the time of service for the towing of the trailer. Trailers must be unloaded prior to service.

AAA Plus Members:

In addition to the vehicles specified for AAA Classic Members, Plus Members are also eligible for the following:

  • Dual-wheel unloaded pickup trucks are eligible for all AAA Emergency Road Service services except tire change services, subject to weight and vehicle length restrictions.

AAA Plus Motorcycle:

In addition to the vehicles specified for AAA Classic and Plus Members, Plus Motorcycle members are also eligible for the following:

  • Motorcycles and scooters are eligible for fuel delivery, locksmith/lockout, winching/extrication services and towing up to 100 miles per incident.

AAA Plus RV and AAA Plus RV & Motorcycle Members:

In addition to the vehicles specified for AAA Classic and Plus Members, Plus RV, and Plus RV & Motorcycle Members are also eligible for the following:

  • Recreational Vehicles (includes dual-wheel campers and motor homes, fifth-wheel trailers, camping, travel and tent trailers) are eligible for lockout/locksmith, fuel delivery, battery, tire change and winching/extrication services, and towing up to 100 miles per incident.
  • Horse trailers, boat and jet ski trailers, and ATV and snowmobile trailers are eligible for tire change, winching/extrication services, locksmith/lockout services, and towing up to 100 miles per incident.
  • Livestock trailers are eligible for air in tire and locksmith/lockout services.
  • Utility and car trailers are eligible for tire service only.
  • Motorcycles and scooters are eligible for fuel delivery, locksmith/lockout, winching/extrication services and towing up to 100 miles per incident.

To the extent that motorcycle services are not available, AAA will reimburse for covered services at the then-current commercial rate for the region. To the extent that a Member with RV coverage (a) requests RV services from outside of such Member's home club's territory state(s) and (b) such RV services are not available in that area through AAA, the Member may submit for reimbursement to the extent that such services are covered by the Member's Membership. Any reimbursements will be calculated at then-current commercial rate for the territory of service.

Premier Membership (Residents of California, Nevada, Utah, Montana, Wyoming, and Alaska):

In addition to the vehicles specified for AAA Classic and Plus Members, Premier Members whose primary residence is in California, Nevada,Utah, Montana, Wyoming, or Alaska are also eligible for the following:

  • Recreational Vehicles (as defined above), motorcycles and scooters are eligible for winching/extrication services, and towing (1 tow up to 200 miles, and the remaining 3 tows up to 100 miles per incident).
  • Utility trailers (e.g., horse and livestock trailers), boat and jet ski trailers, and ATV and snowmobile trailers are eligible for tire change, winching/extrication services and towing.
  • Loaded trailers are eligible for air in tire and locksmith/lockout services.
  • Utility and car trailers may only be eligible for tire service only, subject to certain restrictions (e.g., tire changes are not available for the inside tire of a dual-tire setup).

Premier Membership (Residents of Arizona):

In addition to the vehicles specified for AAA Classic and Plus Members, Premier Members whose primary residence is in Arizona are also eligible for the following:

  • Winching/extrication services, and towing (1 tow up to 200 miles, and the remaining 3 tows up to 100 miles per incident).

Assistance for Members with Disabilities

AAA tow and flatbed vehicle are equipped with footholds and grab handles for the convenience of Members with disabilities. Each tow and flatbed vehicle is equipped with a portable step stool. Note that AAA tow and flatbed vehicles may not be accessible for Members using wheelchairs or scooters. In compliance with all local, state, and federal laws, AAA endeavors to provide Members with alternative accessible transportation services where necessary and appropriate.

Membership, Communication, Reimbursements and Other Policies

Membership Eligibility

The Primary Member is an individual with whom AAA has established the membership and whose name appears first on the membership record (“Primary Member”). Primary Members must be at least 18 years old. One (1) Primary Member is allowed per Membership account. An individual will be a Member on only one Membership at a time. A Primary Member may add up to one (1) Associate Member who is a spouse or resident adult and four (4) Dependent Associate Members. An “Associate Member” is another adult person (which can be a spouse) sharing the same residence as one on file for the Primary Member. A “Dependent Associate Member” is a child or legal ward of the Primary Member, having the same residence as the one on file for the Primary Member (provided that this residency requirement does not apply to a Dependent Associate Member who is away at school). All applications for, and renewals of, Membership are subject to acceptance by AAA.

AAA Emergency Road Service Benefit Effective Period

AAA Emergency Road Service benefits become effective 48 hours after purchasing a new Primary Membership. For new Memberships only, the 48-hour waiting period may be waived if the Member (either a Primary or Associate) elects to pay a non-refundable one-time fee. Upon payment, such Member is entitled to one-time services only at the Classic Membership level.

Members who upgrade their Membership can use their upgraded benefits 10 days after upgrading.

Membership Renewal Policy

We will send you a renewal notice before your Membership expires, and your renewal dues are payable on the day your Membership expires. Upon expiration, Members are granted a “Temporary Waiver Period” up to 90 days, during which time you can pay your renewal fee and maintain your original Membership inception year and renewal date. During this Temporary Waiver Period, we will continue to make Membership services available to you. However, if you request Emergency Road Service during this Temporary Waiver Period, then you are obligated to pay your outstanding renewal fee at the time of such service. If you pay the renewal fee within the Temporary Waiver Period, your Membership will continue uninterrupted and no additional fees will apply.

You must notify us if you’d like to cancel your Membership. If you elect to cancel your Membership, or let it lapse at the end of the Temporary Waiver Period, your Membership will be deemed terminated as of such date. If you later decide to rejoin AAA, you will need to purchase a new Membership, and that Membership will have a new inception year and renewal date as of the new purchase date. If you renew your Membership after the Temporary Waiver Period, AAA Emergency Road Service benefits become effective 48 hours after the purchase of your new Membership, and all other terms and conditions applicable to a new Membership will apply.

Consent to Communications 

By accepting these Membership Terms and Conditions, you are providing us your express written permission and consent authorizing us or our agents to contact you at any phone number (including mobile, cellular, wireless, or similar devices) or email address you provide at any time, for any lawful purpose. The ways which we may contact you include live operator, automatic telephone dialing systems (auto-dialer), prerecorded message, text/SMS messages or email. Such lawful purposes include, but are not limited to: obtaining information; activation of the card for verification and identification purposes; account transactions or servicing related matters; suspected fraud or identity theft; collection on the Membership Account; and providing information about special products and services. You agree to pay any fee(s) or charge(s) that you may incur for incoming communications from us or outgoing communications to us, to or from any such number or email address, without reimbursement from us.

Cancellation Policy

AAA reserves the right to charge back, or cancel Memberships at any time if the Primary or Associate Member is found to be in violation of these Membership Terms and Conditions.

  • Charge backs may include any reasonable administrative, processing or service fees arising from such an attempted violation or for services rendered. Members who have enrolled in auto-renewal may be charged directly using the credit card on file.

In addition, AAA may terminate Members for the following reasons:

  • Unpaid dues
  • Inappropriate or illegal conduct including but not limited to: committing or threatening violence or being abusive to AAA employees, road service technicians, contractors or other AAA representatives; destroying/vandalizing property of AAA or its representatives; or misrepresenting their identity or providing false and/or misleading information at the time of enrollment or request for service;
  • Using the Membership for any reason deemed harmful to the welfare, standing or best interest of AAA or the Membership as a whole, including but not limited to using the Membership benefits for commercial purposes, excessive or inappropriate use, including but not limited to: commercial purposes which include but not limited to: transportation of a vehicle in relation to a sale, non functional vehicles, reselling of AAA services; as a substitute for regular maintenance; or excessive or inappropriate AAA Emergency Road Service use, which includes the use of all four allotments of AAA Emergency Road Services within the first ninety (90) days of the activation or renewal of a Membership

Cancellation and Refund Policy 

Members may cancel their Membership at any time. If a Member cancels their Membership at any time within the first 60 days following enrollment, Member is responsible for the first 60 days of Membership dues and will have access to full Member benefits during that 60 day period.  If a Member cancels their Membership after the first 60 days following enrollment, Membership benefits will cease immediately upon cancellation and Member may qualify for a prorated refund for the remainder of the Membership year if no Emergency Road Service was utilized.

To the extent allowable by law, Members will not be entitled for a prorated refund if:

  • A Member uses any AAA Emergency Road Service during the Membership year; or
  • The Member is terminated for cause

Refunds may take up to 30 days to process.  

Members who fail to pay renewal fees for more than 90 days following the expiration of their Membership will be responsible for the first 60 days of Membership dues following re-enrollment.

Changes in Membership and Refund Policy

A Primary Member may terminate the membership of any Associate or Dependent Associate Member associated with their Membership at any time. The Primary Member is responsible for the first 60 days of Associate and Dependent Associate Member dues following enrollment of Associate and Dependent Associate Member(s).  After the first 60 days following the enrollment of Associate and Dependent Associate Member(s) the Primary Member may qualify for a prorated refund of the fees paid for such Associate membership(s) for the Membership year during which the Associate and Dependent Associate membership(s) is/are terminated.

In addition, a Member may downgrade his or her Membership at any time (e.g., from AAA Plus to AAA Classic). If a Member downgrades the Membership, the Member may qualify for a prorated refund for the difference in dues paid for the original Membership and the dues that would have been paid for the downgraded Membership for the Membership year during which the Membership is downgraded.

Refunds may take up to 30 days to process.

Changes in Membership and Refund Policy

A Primary Member may terminate the membership of any Dependent Associate Member or Associate Member associated with the Membership at any time. The Primary Member may qualify for a prorated refund of the fees paid for such Associate membership(s) for the Membership year during which the Associate membership(s) is/are terminated.

In addition, a Member may downgrade his or her Membership at any time (e.g., from AAA Plus to AAA Classic). If a Member downgrades the Membership, the Member may qualify for a prorated refund for the difference in dues paid for the original Membership and the dues that would have been paid for the downgraded Membership for the Membership year during which the Membership is downgraded.

Refunds may take up to 30 days to process.

Insurance Policy

Residents must have at least one (1) Member named on the policy in order to purchase AAA Auto and/or Home Insurance and be eligible for a Member discount. In California, if your Membership is cancelled, you (1) may not be able to renew your AAA insurance policy and/or (2) you will not be eligible for a Member discount on your premium.

Reimbursement Policy

If AAA service is not available in an area at the time you request service, we will reimburse you for covered services at the usual and customary rate paid by AAA for similar services for the region. If you pay for service within our territory because you do not have your Membership Card with you, or because you do not obtain service from an ICS, we will reimburse you for the amount an ICS would have charged AAA to provide the service (which may be less than the amount you paid for service) upon submission of a receipt in your name. If a covered service cannot be provided because the ICS’s access is restricted (e.g., toll roads, limited-access highway), reimbursement will be limited to the cost of towing the vehicle to the nearest exit or responding garage. Emergency Road Service claims must be submitted within 60 days of the service date. Each approved reimbursement (excluding windshield repair/replacement) will count as a one (1) entitlement for the Membership year in which the reimbursement occurs.

Reimbursement is not provided for:

  • Services paid for under another insurance policy or other program benefit.
  • Charges related to impound or stolen vehicle recovery towing.
  • Charges for vehicle storage.
  • Ridesharing or transportation network services to service destinations when emergency road service vehicles are available to transport the Member.

Windshield Repair/Replacement Reimbursement

AAA Premier Members are eligible for reimbursement of up to $50 one (1) time per Membership year for out-of-pocket expenses to repair or replace a damaged windshield. To receive this reimbursement, you must submit the original receipt or proof of payment along with a completed reimbursement form. Please see above for reimbursement instructions.

Check Guarantee Policy

AAA will guarantee Members’ personal checks for up to $250 only when a valid Membership card and matching photo identification is presented at the time of service. The Check Guarantee Policy applies to:

  • First-party personal checks for the exact amount of the bill. This means second-party checks, business checks and checks made out to cash will not be accepted
  • Checks used for emergency repairs, services or supplies.

AAA will not guarantee checks for bodywork and/or routine maintenance.

Credit/Debit Card Payments

Valid credit cards and debit cards are generally accepted as payment for services.

Auto-Renewal of Memberships

If a Member authorizes AAA to automatically renew the Membership, the Member is agreeing that: (1) such Member is the authorized user of the payment method selected; (2) such Member authorizes AAA to initiate charges to the Member’s credit card or debits to the Member’s bank account/debit card automatically (an automatic payment) for any payment method Member has on-file with AAA (a) each year to pay the Member’s renewal dues up to 7 days prior to the expiration of the Membership, (b) for a $10 fee imposed by AAA for any automatic payment that is rejected by the Member’s bank for insufficient funds, the Member’s account being closed or otherwise (the Member’s bank may also impose a fee for a rejected payment); (3) the Member’s authorization will remain in effect until the Member revokes it as provided below; (4) the amount of the renewal dues may change from time to time in AAA’s discretion, and will be included on a billing statement or other notice sent to the Member before the date on which the dues will be charged or debited; (5) AAA can cancel the Member’s authorization or change these terms upon 30 days’ notice; (6) AAA is authorized to obtain updated or replacement expiration dates and card numbers for the Member’s credit or debit card as provided by the Member’s credit or debit card issuer; and (7) AAA may process the charge for your renewal dues on or up to 7 days prior to the date the Member’s annual Membership period is set to renew.

Members may cancel Automatic Renewal of Membership by using the “Manage Automatic Renewal” feature available through their online Membership account dashboard, by calling 800-922-8228, or by visiting a AAA branch. Please allow up to 10 days to process your Automatic Renewal cancellation. To avoid additional charges, you must cancel at least 18 days prior to the end of your current Membership period. (For details on cancelling your Membership itself, please see above.)

Members who enroll in a Membership plan that automatically renews will receive a one-time discount of ten dollars ($10.00), which will apply solely to such Member’s membership fees (“Automatic Renewal Discount”). The Automatic Renewal Discount is limited to one discount per Membership account, and, for the avoidance of doubt, is not provided on a yearly basis, but instead is a one-time discount available at the time of enrollment in a Membership that automatically renews. Members who have already received the one-time Automatic Renewal Discount will not be eligible for an additional Automatic Renewal Discount if signing up for a Membership within 10 months of cancellation of the first Membership.To cancel your AAA membership, please contact our Membership Department directly at 1-800-922-8228 option # 2 and advise. Travel Emergency Services for AAA Plus and AAA Premier

Who is eligible for coverage?

All Primary, Honorary or Complimentary AAA Members with “AAA Premier” or with “AAA Plus” and Associate Members whose Memberships were issued therewith (“Eligible Member” as further defined below), are eligible for the Travel insurance benefits and assistance coverage (the "Travel Emergency Service") as summarized (the "Summary of Coverage").

Where does coverage apply?

With respect to Emergency Medical Transportation, the Travel Emergency Service territory will be anywhere outside of a 50-mile radius from the Eligible Member’s primary residence, worldwide. With respect to Trip Interruption/Delay and Baggage/Personal Effects, the Travel Emergency Service territory will be outside of a 50-mile radius from the Eligible Member’s primary residence.

When does this coverage start and end?

Coverage for an Eligible Member will take effect on the date such person becomes a member of an eligible class of persons as described above in “Who is eligible for coverage?”

Assistance Service A — Emergency Medical Transportation

Coverage applies to an Eligible Member and any Covered Traveler during each Eligible Trip, up to the limit specified in the Schedule of Benefits.

The insurance provided for this benefit shall be in excess of all other valid and collectible insurance or indemnity.

What is Covered

We will provide benefits, up to the limit specified in the Schedule of Benefits (total for all covered services described below), for the cost of:

1. Moving Eligible Member or a Covered Traveler to a Hospital or medical clinic (Emergency Medical Transportation):

If Eligible Member or a Covered Traveler is seriously ill or injured during the Eligible Trip and Our medical team determines that the local medical facilities are unable to provide appropriate medical treatment:

  • Our medical team will consult with the local doctor;
  • We will identify the closest appropriate facility, make arrangements and pay to transport the person(s) to that facility; and
  • We will arrange and pay for a Medical Escort if We determine one is necessary.

2. Getting Eligible Member or a Covered Traveler home after care (medical repatriation):

If Eligible Member or a Covered Traveler is seriously ill or injured during the Eligible Trip, then once Our medical team determines that the person is medically stable to return home via commercial transportation carrier, such as a scheduled passenger airline, We will:

  • Arrange and pay (less any refunds for unused tickets) for the person to be transported to one of the following: their Primary Residence; a location of their choice in the United States; or a medical facility near their Primary Residence or city of their choice in the United States. We will take their request into consideration as long as the medical facility will accept them as a patient and is approved as medically appropriate for their continued care by Our medical director.
  • Arrange and pay for a Medical Escort if Our medical team determines a Medical Escort is necessary.

3. Bringing a friend or Family Member to stay with Eligible Member or a Covered Traveler (transport to bedside): If Eligible Member or a Covered Traveler is told they will be hospitalized for more than seven days during the Eligible Trip, We will arrange and pay for round-trip transportation in economy class on a Common Carrier for a friend or Family Member to stay with the person.

4. Getting Eligible Member or a Covered Traveler’s children home (return of dependents):

If Eligible Member or a Covered Traveler is told they will be hospitalized for more than seven days during the Eligible Trip, We will arrange and pay (less any refunds for unused tickets) to transport the person’s children under the age of 23 who are traveling with them to one of the following:

  • Their Primary Residence; or
  • A location of their choice in the United States.For medical repatriation and return of dependents, Transportation will be on a Common Carrier in the same class of service they were originally booked.

Conditions of Coverage

Eligible Member, the Covered Traveler, or their representative must contact Us and We must make all transportation arrangements in advance. We will not pay for any of the services listed in this section if We did not authorize and arrange it.

Other Insurance

If at the time of the occurrence of any loss or damage covered by this insurance there is valid and collectible insurance, indemnity or warranty in place, We shall be liable only for the excess of the amount of such loss or damage over the amount of such other insurance, indemnity or warranty and for the amount of any applicable deductible, subject to the limits of liability as stated in the Schedule of Benefits. In no event shall this take precedence over any other “non-contribution” clauses found in other insurance, policies, indemnities or warranty language. This provision applies only to the Emergency Medical Transportation Coverage.

Coverage A — Trip Interruption/Delay for AAA Plus and Premier

Coverage applies to the Eligible Member and any Covered Traveler during each Eligible Trip, up to the limit specified in the Schedule of Benefits.

What is Covered

The Company will provide benefits for Trip Interruption due to the following events:

  1. Vehicle disablement due to Mechanical Breakdown (excluding tire trouble), substantiated by garage or repair facility or rental car company report;
  2. Accident involving Motor Vehicle or Rental Car, substantiated by a police report;
  3. Theft of Motor Vehicle or Rental Car, substantiated by a police report;
  4. Illness, injury, or death of the insured person, covered traveler, insured person’s family member, or adult with whom the insured person resides who is not traveling with the insured person (including being diagnosed with an epidemic or pandemic disease such as COVID-19).The following conditions apply: a. For interruptions due to illness or injury of the insured person or covered traveler, a physician must recommend that the person interrupt the trip due to the severity of the person’s condition. b. For interruptions due to illness or injury of the insured person’s family member or an adult with whom the insured person resides who is not traveling with the insured person, the illness or injury must be life threatening, require hospitalization, or he or she must require the insured person’s care. c. The insured person or covered traveler must not have traveled against the orders or advise or any government or other public authority at any location to, from, or through which the insured person or covered traveler is traveling during the tripMember or adult with whom the Eligible Member resides who is not traveling with the Eligible Member;
  5. Natural Disaster; or
  6. Severe Weather.

The benefit will provide reimbursement for out-of-pocket expenses incurred by the Eligible Member or Covered Traveler up to the limit specified in the Schedule of Benefits for:

  1. The cost of additional Accommodations and meal expenses; AND (if applicable),
  2. The cost of substitute transportation to continue the Eligible Trip.

Conditions of Coverage

The following conditions apply to this coverage part:

  1. Overnight interruption of the Eligible Trip is required.
  2. If the Trip Interruption is due to Illness or Injury of the Eligible Member or Covered Traveler, a Physician must recommend that the person interrupt the Eligible Trip due to the severity of the person’s condition.
  3. If the Trip Interruption is due to Illness or Injury of the Eligible Member’s Family Member or an adult with whom the Eligible Member resides who is not traveling with the Eligible Member, the Illness or Injury must be life threatening, require hospitalization, or he or she must require the Eligible Member’s care.

Limitations of Coverage

Only expenses incurred in the first ninety-six (96) hours from the initial interruption of the Eligible Trip are covered.

EXCLUSIONS

Coverage is not provided for any loss that results directly or indirectly from any of the following:

  1. Alcohol or substance abuse or use, or conditions or physical complications related thereto;
  2. War (whether declared or undeclared), acts of war, military duty, civil disorder or unrest;
  3. Participation in professional or amateur sporting events (including training);
  4. All extreme, high risk sports including but not limited to: bodily contact sports, skydiving, hang gliding, bungee jumping, parachuting, mountain climbing or any other high altitude activities, caving, heli-skiing, extreme skiing, or any skiing outside marked trails;
  5. Scuba diving (unless accompanied by a dive master and not deeper than 130 feet);
  6. Operating or learning to operate any aircraft as pilot or crew;
  7. Nuclear reaction, radiation or radioactive contamination;
  8. Epidemic;
  9. Pollution or threat of pollutant release;
  10. Any unlawful acts committed by You or a Covered Traveler; or
  11. Any expected or reasonably foreseeable events.

Coverage B — Baggage/Personal Effects

Coverage applies to the Eligible Member and any Covered Traveler during each Eligible Trip within the Policy Territory, up to the limit specified in the Schedule of Benefits when the Covered Traveler is either a driver or passenger in the Motor Vehicle or Rental Car used for the Eligible Trip.

What is Covered

The Company will provide benefits for Baggage that is lost, damaged or stolen, up to the limit specified in the Schedule of Benefits.

The benefit will provide payment for the value of the Baggage, which is equal to the lesser of:

  1. The actual purchase price of a similar item;
  2. The Actual Cash Value of the item at the time of loss which includes deduction for depreciation (for items without receipts, the program will pay up to 75% of the determined depreciated value); or
  3. The cost to repair or replace the item.

Conditions of Coverage

For this coverage part, the Eligible Member or Covered Traveler must take reasonable steps to keep Baggage safe and intact; to recover it; and to notify the appropriate authorities within 24 hours of the covered loss.

Limitations of Coverage

Coverage is not provided for any loss that results directly or indirectly from:

  1. Intentional loss of or damage to Baggage;
  2. Defective materials or workmanship; or
  3. Ordinary wear and tear.

Property or losses not covered includes:

  1. Animals;
  2. Cars and accessories, motorcycles and motors, aircraft, boats, and other vehicles;
  3. Bicycles, skis, and snowboards;
  4. Eye glasses, sunglasses, and contact lenses;
  5. Hearing aids, artificial teeth, and limbs;
  6. Wheelchairs and other mobility devices;
  7. Consumables, medicines, perfumes, cosmetics, and perishables;
  8. Tickets, passports, deeds, and other documents;
  9. Money, credit cards, debit cards, securities, bullion, and stamps;
  10. Rugs and carpets;
  11. Property for business or trade; and
  12. Baggage when it is shipped as freight, shipped prior to the date of the Eligible Trip, left in or on a car trailer, or left in an unlocked car.

General Provisions

This guide to benefits is neither a policy nor contract of insurance, but is your most complete source of information. Please be sure to keep it in a safe place.

All information in this document is subject to the terms and conditions of the Master Policy, a copy of which is in the possession of AAA. The terms and conditions of the Master Policy agree with the terms outlined in this guide to benefits. However, features and benefits are subject to change without notice.

How to File a Claim: Please gather the information below if you have a covered loss during your Covered Travel as it will be requested when you file a claim upon returning home. All claims must be reported to Allianz Global Assistance within 30 days from the date of loss or as soon after that date as is reasonably possible.

Once you report a claim, the service associate will set up a claim file for you and send you a claim form. You must send written proof of loss, including any required information necessary to support the claim, to Allianz Global Assistance within 90 days from the date of loss, or as soon after that date as reasonably possible, and in no event, except in the absence of legal capacity, later than one year from the time.

Claim Forms. We will furnish claim forms to Eligible Member within 15 days of receipt of a notice of claim. If these forms are not furnished within 15 days, Eligible Member will satisfy this requirement by sending Us written proof of loss. This proof should include information sufficient to identify the applicable Eligible Member, the Policy number, and a description of both the occurrence and the nature and extent of the loss.

Time of Payment of Claims. We will pay the claim after receipt of acceptable proof of loss. Claims will be paid in accordance with the payment of claims provision.

Payment of Claims. All claims will be paid to Eligible Member, if living; otherwise to Eligible Member’s estate. Any payment made in good faith will discharge Our liability to the extent of that payment.

Definitions

“Accident” – means an unexpected, unintended, unforeseeable event causing Injury or death to You or a Covered Traveler; or causing damage to the Motor Vehicle or Rental Car that prevents the vehicle from being driven.

“Accommodations” – means temporary lodging in an establishment licensed to provide temporary lodging to paying guests.

“Actual Cash Value” – means purchase price less depreciation.

“Baggage” – means the personal property that an Eligible Member or a Covered Traveler takes on the Eligible Trip and the suitcases or other kinds of containers used to carry them.

“Common Carrier” – means a company that is licensed to carry passengers on land, water or in the air for a fee, not including car rental companies.

“Covered Traveler” – means a person who is an Immediate Family Member and is traveling with Eligible Member.

“Eligible Member” – means a person:

  1. Who is a member of an Eligible Class of persons as described in the Eligibility Class section of the Schedule of Benefits;
  2. For whom premium has been paid; and
  3. While covered under the Policy.

An Eligible Member may be Primary or Secondary Member. Primary Eligible Member is a AAA member possessing the primary membership in a household. Secondary Eligible Member is any AAA Member possessing an Associate membership in a household.

“Eligible Trip” – means a Trip which:

  1. Does not exceed, and was not planned to exceed, 45 consecutive days;
  2. Was intended to include at least one overnight stay
  3. For Trip Interruption, vehicle return, stolen baggage/personal effects, and baggage: is a driving trip taken by Motor Vehicle, Rental Car, Common Carrier, or a combination of these.
  4. For all other coverage (including emergency medical transportation, repatriation of remains): is a trip taken by Motor Vehicle, Rental Car, Common Carrier, or a combination of these.

“Family Member” – means the AAA Member’s spouse, civil union partner or domestic partner; children and stepchildren (including children who are or are in the process of becoming adopted); parents and stepparents; siblings; grandparents and grandchildren; in-laws (mother, father, son, daughter, brother, sister).

“Hospital” – means a provider that is a short-term, acute, general Hospital that:

  1. Is a duly licensed institution;
  2. In return for compensation from its patients, is primarily engaged in providing inpatient diagnostic and therapeutic services for the diagnosis, treatment, and care of injured and sick persons by or under supervision of physicians;
  3. Has organized departments of medicine and major surgery;
  4. Provides 24-hour nursing service by or under the supervision of registered graduate nurses; and
  5. Is not other than incidentally: (a) a skilled nursing facility, nursing home, custodial care home, health resort, spa or sanatorium, place for rest, place for the aged, place for the provision of rehabilitation care; (b) a place for the treatment of mental illness; (c) a place for the treatment of alcoholism or drug abuse; (d) a place for the provision of hospice care; or (e) a place for the treatment of pulmonary tuberculosis.

“Illness” – means a sickness, infirmity or disease that causes a loss that begins during an Eligible Trip.

“Immediate Family Member” – means the AAA member’s spouse, civil union partner or domestic partner; children and stepchildren (including children who are or are in the process of becoming adopted) under the age of 21; parents, stepparents, siblings, grandparents, and grandchildren who reside with You.

“Injury” – means bodily injury caused by an Accident occurring during an Eligible Trip, and resulting directly and independently of all other causes in loss.

“Mechanical Breakdown” – means a mechanical issue that prevents the vehicle from being driven. Mechanical Breakdown does not include running out of gas, tire trouble or failure to perform routine maintenance

“Medical Escort” – means a professional person contracted by Our medical team to accompany a seriously ill or injured person while they are being transported. A Medical Escort is trained to provide medical care to the person being transported. A friend or Family Member cannot be a Medical Escort.

“Motor Vehicle” – means a self-propelled private passenger vehicle that is a type both designed and required to be licensed for use on public roads. The term Motor Vehicle does not include:

  1. Motorcycles (except as noted below);
  2. Trucks (except for pickup trucks and vans);
  3. Trailers;
  4. Motorbikes and all-terrain vehicles;
  5. Off-road vehicles;
  6. Vehicles that don’t have to be licensed;
  7. Vehicles that are used for commercial or livery purposes, including limousines; or
  8. Other conveyances.

If Eligible Member’s AAA Membership explicitly includes motorcycles, then motorcycles are included in the term Motor Vehicle in that situation.

“Natural Disaster” – means an event, including but not limited to wind storm, rain, snow, sleet, hail, lightning, dust or sand storm, earthquake, tornado, flood, volcanic eruption, wildfire or other similar event that:

  1. Is due to natural causes; and
  2. Results in widespread severe damage such that the area of damage is officially declared a disaster area and the area is deemed to be uninhabitable or dangerous.

“Personal Effects” – means items that are regularly worn or carried and can include keys, identification card, wallet, watch, clothing and toiletries.

“Physician” – means a licensed practitioner of the healing arts acting within the scope of their license. The attending physician may not be: (a) an Eligible Member; (b) an Eligible Member’s spouse, civil union partner or domestic partner; (c) a person booked to accompany an Eligible Member on an Eligible Trip; or (d) a person who is related to an Eligible Member, an Eligible Member’s spouse, civil union partner or domestic partner, child, parent, or sibling.

“Policy Territory” – means

  1. For Trip Interruption, Vehicle Return, Stolen Baggage, and Baggage and Emergency Medical Transportation: Outside of a 50 mile radius from Eligible Member’s Primary Residence.

“Primary Residence” – means Eligible Member’s permanent and main home for legal and tax purposes. It does not include any secondary or vacation home or residence.

“Rental Car” – means Motor Vehicle that is rented by Eligible Member and evidenced by a car rental agreement. The term Rental Car does not include:

  1. Motorcycles, Motorbikes and all-terrain vehicles;
  2. Trucks;
  3. Campers, trailers and recreational vehicles;
  4. Off-road vehicles;
  5. Vehicles that don’t have to be licensed;
  6. Vehicles that are used for commercial or livery purposes, including limousines; or
  7. Other conveyances.

“Severe Weather” – means

  1. The local government or the National Weather Service issues an advisory against travel as a result of rain, snow or wind; or
  2. A "state of emergency" due to weather is declared by the federal, state or local government.

“Trip” – means a planned round-trip travel to and from a place at least 50 miles from Your Primary Residence. A trip does not include travel to receive health care or medical treatment of any kind, vehicle repairs, or commuting to and from work.

“We”, “Us”, “Our” – means, or refers to, BCS Insurance Company, including its authorized agents.

“You”, “Your”, “Yours” – means, or refers to, the Eligible Member.

AAA Travel Agency Travel Accident Insurance Program for AAA Premier

The Travel Accident Insurance Program covers AAA Members & Eligible Family Members with up to $300,000 when travel arrangements are made through your local AAA Travel Agency.

Coverage applies to You and any Covered Traveler during each Eligible Trip within the Policy Territory, up to the limit specified in the Schedule of Benefits (download here).

The Travel Accident Insurance Program covers AAA Premier Members that book and purchase travel on a licensed Common Carrier and rental car through the AAA Travel Agency. Coverage includes accidental loss of life, limbs, sight, speech or hearing. “Common Carrier” means any land, water or air conveyance operated by those whose occupation or business is the transportation of persons without discrimination and for hire.

Coverage Applies

  1. While you are riding solely as a passenger in, entering or exiting any conveyance operated by a Common Carrier licensed for the transportation of passengers for hire.
  2. While you are riding solely as a passenger in, entering or exiting any conveyance operated by a Common Carrier licensed for the transportation of passengers for hire, while traveling directly to or from a terminal, station or airport; a) immediately preceding scheduled departure of a Common Carrier; or b) immediately following scheduled arrival of a Common Carrier.
  3. Riding or driving in, entering or exiting from a private passenger automobile of the strictly pleasure car type; while going directly to the departure point or while coming from the arrival point of a Common Carrier.
  4. While riding or driving in, entering or exiting from a rental car whose lease has been arranged through your participating AAA Travel Agency in conjunction with any airline or other common carrier transportation.

Common Carrier and Auto Benefits

The full Benefit Amount of $300,000 is payable for accidental loss of: life, two or more members, sight of both eyes, speech and hearing or any combination thereof. One half of the Benefit Amount is payable for accidental loss of: one member, sight of one eye, speech or hearing. As used in this paragraph, “member” means hand or foot. One quarter of the Benefit Amount is payable for the accidental loss of the thumb and index finger of the same hand. “Loss” means, with respect to a hand, complete severance throughout or above the knuckle joints of at least four (4) fingers on the same hand; with respect to a foot, complete severance through or above the ankle joint. Federal Insurance Company (The Company) will consider it a loss of hand or foot even if they are later reattached. If an Insured Person has multiple Losses as the result of one Accident, only the single largest Benefit Amount applicable to the Losses suffered will be paid. 100% of the benefit is paid if the accident causes the Insured Person to suffer loss of use of both arms and legs; 75% of the Benefit for both arms or both legs or a combination of an arm and a leg; 50% of the Benefit for one arm or one leg, or both hands or both feet or a combination of a hand and a foot; 25% of the Benefit for one hand or one foot.

Seat Belt Benefit

Accidental Loss of Life Benefits payable under the Private Passenger Automobile coverage of this policy will be increased 10 percent of the loss of life benefit amount up to a maximum amount of $50,000, if at the time of the Accident the Insured Person suffers Accidental Loss of Life while:

  1. operating or riding in a Private Passenger Automobile and
  2. utilizing a Seat Belt

A Benefit Amount will not be paid if the Insured Person is driving or riding as a passenger in any race, or contest of any type. The seatbelt usage must be verified by a licensed Physician, a coroner, a police officer or other person of competent authority. The seat belt must have been properly secured, and utilized in accordance with the recommendations of its manufacturer. Private passenger automobile means a four-wheeled motor vehicle with a maximum seat capacity of nine (9), manufactured and designed to travel on public roads.

In-Hospital Benefit

Benefits of $150 per day for each day hospitalized, up to a total of seven days, will be paid in addition to the Accidental Loss of Life Benefit and other benefit amounts for the losses covered, to the Insured Person if an accident covered under this policy results in the hospitalization of the Insured Person. In-Hospital means that the Insured Person is registered as an in-patient and confined to a hospital, while being treated by a licensed physician. Periods of hospitalization include all In-Hospital stays related to the same Accident. The Benefit Amount will be paid until one of the following occurs:

  1. The Insured Person dies; or
  2. The Insured Person is no longer hospitalized; or
  3. The maximum number of days (7) of payment has expired.

Maximum Limit of Insurance

If more than one (1) Insured Person suffers a loss in the same accident, The Company will not pay more than $20,000,000 per accident. If an accident results in benefit amounts becoming payable, which when totaled exceed $20,000,000, the maximum limit of insurance will be proportionately divided among the insured persons, based on each applicable benefit amount.

Definitions

"Loss of Use" means the permanent and total inability of the specified body part to function, as determined by a physician.

"Loss of Use of Arm" means the Loss of Use of the arm at or above the elbow joint. Loss of Use of Foot means the Loss of Use of the foot at or above the ankle joint.

"Loss of Use of Hand" means the Loss of Use at or above the knuckle joints of at least four (4) fingers on the same hand or at least three (3) fingers and the thumb on the same hand.

"Loss of Use of Leg" means the Loss of Use of the leg at or above the knee joint. Loss must occur within 365 days from the date of accident.

"Loss of Sight of an Eye" means the permanent loss of vision in one eye. Remaining vision must be no better than 20/200 using a corrective aid or device as determined by a physician.

"Loss of Speech" means the permanent and irrecoverable total loss of the capability of speech without the aid of mechanical devices, as determined by a physician.

"Loss of Hearing" means the permanent and irrecoverable Loss of Hearing in both ears, as determined by a physician.

Exclusions

This insurance does not cover loss resulting from:

  1. an Insured’s emotional trauma, mental or physical illness, disease, pregnancy, childbirth or miscarriage, bacterial or viral infection (except bacterial infection caused by an accident or from accidental consumption of a substance contaminated by bacteria), or bodily malfunctions;
  2. suicide, attempted suicide or intentionally self inflicted injuries;
  3. declared or undeclared war, but war does not include acts of terrorism.
  4. This insurance does not apply to an accident occurring while an Insured is in, entering, or exiting any aircraft while acting or training as a pilot or crew member. This exclusion also does not apply to passengers who temporarily perform pilot or crew functions in a life threatening emergency;
  5. This insurance does not apply to an Accident occurring while an Insured Person is in, entering, or existing any aircraft owned, leased or operated by the Policyholder or any aircraft owned, leased or operated by an employee of the Policyholder on behalf of the Policyholder. This exclusion does not apply to aircraft chartered with pilot or crew on a one time charter basis.

Beneficiary

The Loss of Life Benefit will be paid to the beneficiary designated by the Insured. If no such designation has been made, that benefit will be paid to the first surviving beneficiary in the following order: a) the Insured person’s spouse or domestic partner; b) the Insured person’s children; c) the Insured person’s parents; d) the Insured person’s brothers and sisters; e) the Insured’s estate. All other indemnities will be paid to the Insured.

Notice of Claim

Written notice of claim should be mailed to your local AAA office.

The Cost

The premium for this Travel Accident Insurance is paid for by AAA for AAA Premier Members.

Change of Beneficiary

The Loss of Life Benefit will be paid to the beneficiary designated by the Insured. If no such designation has been made, that benefit will be paid to the first surviving beneficiary in the order stated in the Beneficiary Section. If you wish to change beneficiaries, please contact your AAA Travel Agency.

NOTE: The information contained in these Membership Terms and Conditions is a description of the coverage, benefits and exclusions contained in the Master Policy 6477-01-32. The Policy Number and Master Policy are on file with the Policyholder. All information is subject to the terms and conditions of the Master Policy. By opting into AAA’s text messaging program(s) or by otherwise providing your cell phone to AAA, you warrant that you are 18 years of age or older.  You further warrant that you are the current subscriber or authorized user of the phone number you have provided.  If you change, forfeit, or deactivate the phone number you have provided to AAA, you agree to notify AAA immediately.  AAA reserves the right to modify or discontinue, temporarily or permanently, all or any part of its text message programs, with or without notice.  

GOVERNING LAW AND ARBITRATION; CLASS ACTION WAIVER 

Governing Law

Subject to the section below, titled “Right to Seek Injunctive Relief,” these SMS Terms and any claims, disputes, or causes of action relating to or arising out of the issues addressed in these SMS Terms or your receipt of text messages from AAA or its affiliates (collectively “Disputes”) shall be construed, unless otherwise prohibited by law, in accordance with and governed by the laws of the state of California, without giving effect to the conflict of laws principles thereof.  All Disputes which cannot be amicably settled shall be submitted to arbitration as set forth below.  

Dispute Resolution and Mandatory Binding Arbitration

Prior to arbitration, the parties shall seek informal resolution of Disputes. The process shall be initiated with written notice of one party to the other, describing the Dispute with reasonable particularity. The other party shall respond within ten (10) calendar days. Each party shall promptly designate an executive with requisite authority to resolve the Dispute, and the first meeting shall occur within 10 calendar days from the response described above. If the Dispute is not resolved within 10 calendar days of the first meeting, either party may proceed to arbitration as set forth below.

The parties agree that any Dispute between them, including any Dispute as to the validity or applicability of this arbitration clause, shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except where those rules are intentionally varied by the parties herein or pursuant to mutual agreement. The parties expressly agree that the arbitration shall be conducted in California, in the English language, and under California law, unless the parties mutually agree otherwise or the arbitrator determines that under applicable law, the arbitration is to take place in a location other than California or that the laws of a State other than California governs. To the extent permitted by applicable law, the prevailing party shall be entitled to a reimbursement of all of its reasonable attorneys’ fees and arbitration costs by the other party. The arbitration award shall be final.

The parties enter into this arbitration agreement in connection with a transaction involving interstate commerce.  Accordingly, this arbitration agreement, and any proceedings thereunder, shall be governed by the Federal Arbitration Act (“FAA”) 9 USC 1-16. Any award by the arbitrator may be entered as a judgment in any court having jurisdiction.

IF YOU DO NOT WISH TO AGREE TO THIS ARBITRATION PROVISION, YOU MUST NOTIFY AAA IN WRITING BY EMAILING AAA AT [email protected] OR BY MAIL TO: AAA Northern California, Nevada & Utah, 1277 Treat Blvd., Suite 1000, Walnut Creek, CA 94597, Attn: Legal Department.  Include your name, address, and a clear statement that you do not agree to this Arbitration Provision.

Class Action Waiver.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ARBITRATION SHALL PROCEED SOLELY ON AN INDIVIDUAL BASIS WITHOUT THE RIGHT FOR ANY DISPUTES TO BE ARBITRATED OR LITIGATED ON A CLASS ACTION BASIS OR ON BASES INVOLVING CLAIMS BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF OTHERS OR ANY GOVERNMENTAL BODY OR THE PUBLIC. DISPUTES MAY NOT BE JOINED OR CONSOLIDATED UNLESS AGREED TO IN WRITING BY ALL PARTIES. TO THE EXTENT EITHER PARTY IS PERMITTED BY LAW OR COURT OF LAW TO PROCEED WITH A CLASS OR REPRESENTATIVE ACTION AGAINST THE OTHER, THE PARTIES AGREE THAT THE PREVAILING PARTY SHALL NOT BE ENTITLED TO RECOVER ATTORNEYS’ FEES OR COSTS ASSOCIATED WITH PURSUING THE CLASS OR REPRESENTATIVE ACTION (NOT WITHSTANDING ANY OTHER PROVISION IN THIS AGREEMENT).

Waiver of Rights, Including Trial By Jury.

By agreeing to arbitration, the parties understand and agree that they are waiving their rights to maintain other available resolution processes, such as a court action or administrative proceeding, to settle their Disputes. The rules in arbitration are different. There is no judge or jury, and review of an arbitrator’s decision is very limited. EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL INVOLVING ANY CLAIMS OR DISPUTES. 

Right to Seek Injunctive Relief

This agreement to arbitration does not preclude either party from seeking injunctive relief in a court of law in accordance with applicable law.

NOTICE OF ARBITRATION PROVISION:  AS SET FORTH FULLY IN THE SECTION BELOW TITLED “DISPUTE RESOLUTION AND ARBITRATION AGREEMENT”, YOU AND AAA AGREE TO AN ARBITRATION PROVISION THAT PROVIDES THAT (EXCEPT FOR MATTERS PROPERLY BROUGHT TO SMALL CLAIMS COURT AS SET FORTH BELOW) ANY CLAIM, CONTROVERSY, OR DISPUTE RELATED TO OR CONCERNING THE SITES THAT CANNOT BE RESOLVED INFORMALLY MUST BE RESOLVED BY AN ARBITRATION PROCEEDING THAT IS FINAL AND BINDING ON YOU AS AN INDIVIDUAL AND NOT ON A CLASS-WIDE, REPRESENTATIVE, OR CONSOLIDATED BASIS. WITH RESPECT TO SUCH CLAIMS, YOU AND AAA WAIVE THE RIGHT TO A TRIAL BY JURY AND THE ABILITY TO BRING OR PARTICIPATE IN CLASS OR REPRESENTATIVE ACTIONS, WHETHER IN COURT OR BY ARBITRATION. THE ARBITRATOR SHALL HAVE THE AUTHORITY TO AWARD ANY RELIEF AUTHORIZED BY LAW IN CONNECTION WITH THE ASSERTED CLAIMS OR DISPUTES. 

Changes to These Terms

We may revise these Terms from time to time. We will advise you of all material changes through a notice in accordance with applicable legal requirements. Each time changes are made; they will be available through our Sites. Your continued use of our Sites following the posting of any changes to these Terms constitutes your acceptance of those changes.

Accounts

In order to use certain features of the Sites, you must register for an account with AAA (“AAA Account”) and provide certain information about yourself as prompted by the site registration form. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; and (b) you will maintain the accuracy of such information.

You are responsible for maintaining the confidentiality of your AAA Account login information and are fully responsible for all activities that occur under your AAA Account. You agree to immediately notify AAA of any unauthorized use or suspected unauthorized use of your AAA Account or any other breach of security. AAA cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

Intellectual Property Rights

Excluding your User Content (defined below), the Sites and its entire contents, features and functionality (including, but not limited to, all information, text, graphics, photographs, videos, sounds, music, logos, trademarks, services marks, and the design, selection and arrangement thereof contained on this Site or in the Services) are owned by AAA, its licensors or other providers of such material and are protected by United States and international copyright, trademark, trade secret, patent, and other intellectual property or proprietary rights laws. You are permitted to use the Sites and Services only as expressly stated in these Terms. No right, title or interest in or to the Sites or any content on the Sites is transferred to you, and all rights not expressly granted are reserved by the AAA. Any use of the Sites not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark and other laws.

Restrictions

You may use the Sites and Services only for lawful purposes in accordance with these Terms. You agree not to use the Sites or Services in any way that violates any applicable federal, state, or local law or regulation.

Your access to and use of the Services is subject to the following restrictions: (a) you shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Sites or Services; (b) you shall not modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Sites or Services; (c) you shall not access the Sites or Services in order to build a similar or competitive service; and (d) except as expressly stated herein, no part of the Sites or Services may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means. All copyright and other proprietary notices on any Sites or Services content must be retained on all copies thereof.

Modifications of Sites; Termination

We reserve the right, at any time, without notice and for any reason, to modify, remove, suspend, or discontinue the Sites or Services, and to deny access of any user to all or any part of the Site or Services. You agree that AAA will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Sites or Services or any part thereof. Any update or other addition to functionality of the Site or Services shall be subject to these Terms.

User Content

“User Content” means any and all information and content that a user submits to, or uses with, the Sites or Services (e.g., content in the user’s profile or postings). You are solely responsible for your User Content. You assume all risks associated with use of your User Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your User Content that makes you or any third party personally identifiable. You hereby represent and warrant that your User Content does not violate the Acceptable Use Policy (defined below). You may not state or imply that your User Content is in any way provided, sponsored or endorsed by AAA. Because you alone are responsible for your User Content (and not AAA), you may expose yourself to liability if, for example, your User Content violates the Acceptable Use Policy or other applicable laws. AAA is not obligated to backup any User Content and User Content may be deleted at any time. You are solely responsible for creating backup copies of your User Content if you desire.

You hereby grant, and you represent and warrant that you have the right to grant to AAA an irrevocable, nonexclusive, royalty-free and fully paid, worldwide license to reproduce, distribute, publicly display and perform, prepare derivative works of, incorporate into other works, and otherwise use your User Content, and to grant sublicenses of the foregoing, solely for the purposes of including your User Content in the Sites and Services. You irrevocably waive (and cause to be waived) any claims and assertions of moral rights or attribution with respect to your User Content.

Acceptable Use Policy

The following sets forth AAA’s “Acceptable Use Policy”:

You agree not to use the Sites or Services to collect, upload, transmit, display, or distribute any User Content (a) that violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (b) that is unlawful, harassing, abusive, tortious, threatening, harmful, invasive of another’s privacy, vulgar, defamatory, false, intentionally misleading, trade libelous, pornographic, obscene, patently offensive, promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual or is otherwise objectionable; (c) that is harmful to minors in any way; or (d) that is in violation of any law, regulation, or obligations or restrictions imposed by any third party.

In addition, you agree not to use the Sites or Services to: (i) upload, transmit, or distribute any computer viruses, worms, or any software intended to damage or alter a computer system or data; (ii) send unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (iii) harvest, collect, gather or assemble information or data regarding other users, including e-mail addresses, without their consent; (iv) interfere with, disrupt, or create an undue burden on servers or networks connected to the Sites or Services or violate the regulations, policies or procedures of such networks; (v) attempt to gain unauthorized access to the Sites or Services, other computer systems or networks connected to or used together with the Sites or Services, through password mining or other means; (vi) harass or interfere with another user’s use and enjoyment of the Sites or Services; or (vi) introduce software or automated agents or scripts to the Sites or Services so as to produce multiple accounts, generate automated searches, requests and queries, or to strip, scrape, or mine data from the Sites or Services (except that we grant the operators of public search engines revocable permission to use spiders to copy materials from the Sites for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials).

We reserve the right (but have no obligation) to review any User Content, investigate, and/or take appropriate action against you in our sole discretion if you violate the Acceptable Use Policy or any other provision of these Terms or otherwise create liability for us or any other person. Such acts may include removing or modifying your User Content, terminating your AAA Account in accordance with the Terms, and/or reporting you to law enforcement authorities.

Feedback

If you provide AAA any feedback or suggestions regarding the Sites or Services (“Feedback”), you hereby assign to AAA all rights in the Feedback and agree that AAA shall have the right to use such Feedback and related information in any manner it deems appropriate. AAA will treat any Feedback you provide to AAA as non-confidential and non-proprietary. You agree that you will not submit to AAA any Feedback that you consider to be confidential or proprietary.

Indemnity

You agree to defend, indemnify and hold harmless AAA, its affiliates, licensors and service providers, and its and their respective owners, shareholders, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees and costs) arising out of or relating to (a) your use of the Sites or Services, (b) your User Content, (c) your violation of these Terms; or (d) your violation of applicable laws or regulations. AAA reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of AAA. AAA will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

No Warranties

THE SITES AND SERVICES ARE PROVIDED “AS-IS” AND “AS AVAILABLE” AND WE (AND OUR SUPPLIERS) EXPRESSLY DISCLAIM ANY WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, NON-INFRINGEMENT, AND ANY IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OR TRADE AND ALL SUCH IMPLIED WARRANTIES ARE EXPRESSLY AND SPECIFICALLY DISCLAIMED.. WE (AND OUR SUPPLIERS) MAKE NO WARRANTY THAT THE SITES OR SERVICES: (A) WILL MEET YOUR REQUIREMENTS; (B) WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; OR (C) WILL BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE. AAA DOES NOT WARRANT THAT YOU WILL QUALIFY FOR SERVICES OFFERED ON THE SITES OR THAT THE SERVICES OFFERED THROUGH THE SITES ARE AVAILABLE IN ALL JURISDICTIONS.

SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.

Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, AAA’S TOTAL LIABILITY AND YOUR EXCLUSIVE REMEDY UNDER OR RELATED TO YOUR USE OF THE SITES OR SERVICES IS LIMITED TO DIRECT MONEY DAMAGES NOT TO EXCEED FIFTY U.S. DOLLARS ($50.00). THIS LIMIT IS CUMULATIVE, AND ALL PAYMENTS MADE BY AAA PURSUANT TO THESE TERMS ARE AGGREGATED TO CALCULATE SATISFACTION OF THE LIMIT.

TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE (OR OUR AFFILIATES, LICENSORS, OR ICS) BE LIABLE FOR ANY LOST PROFIT OR REVENUE OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF AAA IS AWARE OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES. ACCESS TO, AND USE OF, THE SITES, PRODUCTS AND SERVICES ARE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA RESULTING THEREFROM.

You agree that AAA is not responsible or liable for any acts or omissions created or performed by these third parties. AAA does not operate or control in any way any information, software, products or services available on such third-party websites. If you decide to access any of the third-party websites linked to the Sites, you do so entirely at your own risk and subject to the terms and conditions of use for such third-party websites.

User Content Disclaimer and Release

Each Site or Service user is solely responsible for any and all of its User Content. Because we do not control User Content, you acknowledge and agree that we are not responsible for any User Content and we make no guarantees regarding the accuracy, currency, suitability, or quality of any User Content, and we assume no responsibility for any User Content. Your interactions with other Site or Service users are solely between you and such user. You agree that AAA will not be responsible for any loss or damage incurred as the result of any such interactions. If there is a dispute between you and any Site or Service user, we are under no obligation to become involved.

You hereby release and forever discharge us (and our officers, employees, agents, successors, and assigns) from, and hereby waive and relinquish, each and every past, present and future dispute, claim, controversy, demand, right, obligation, liability, action and cause of action of every kind and nature (including personal injuries, death, and property damage), that has arisen or arises directly or indirectly out of, or relates directly or indirectly to, any interactions with, or act or omission of, other Site or Service users or Third Party Sites & Ads. Payments

You may order Services by following the directions on the Sites. Once you order a Service, your subscription to the Service will automatically renew until you cancel your Service by following the directions on the Sites. AAA may change the pricing for the Services (from time to time in its discretion) by updating the Sites and without any additional notice to you, provided that any changes will not take effect until your subscription is renewed.  In addition, the Service fee may increase or decrease in accordance with your request for a policy change or in connection with other factors that affect your Service. With respect to insurance rates, our quotes are estimates based upon information provided by users on our detailed questionnaires. However, these quotes could change based on additional or contradictory information that emerges during the final insurance underwriting process. Refunds for check or debit card transactions may take up to 30 days to be processed.

If you order a Service, you agree to pay the then-current applicable Service fee listed on the Sites. The Sites allow for one-time and recurring payments for Services offered either by AAA, third-party service providers, or by one of the AAA Companies. The “AAA Companies” are (a) the American Automobile Association, Inc.; (b) any entity with "AAA" or "American Automobile Association" in its name or brand, including each AAA auto club and CSAA Insurance Exchange; or (c) any entity affiliated with any of the foregoing or acting as an insurer or a re-insurer of any of the foregoing, including subsidiaries and holding companies such as AAA Club Partners, Inc.

AAA will bill your credit card or debit card submitted in ordering the Service on the date the Service is activated. Please see each service for policies and details on refunds, if any. If you agree to automatic payments for one or more Services, you are consenting to AAA Companies to deduct the pre-determined amount from the account you specified on a date each month that AAA deems appropriate. You agree these charges shall continue until you cancel the automatic payments or cancel the Service. If you feel you have been billed in error or you wish to dispute any charge, or cancel the Service, you may do so by contacting AAA. All information that you provide to us, or our third-party payment processor must be accurate, current and complete. In the event of a dispute AAA Companies may issue you with a provisional credit until the dispute is resolved. If AAA Companies issue a provisional credit and the dispute is resolved and the charges were correct, AAA Companies shall recharge your account to reverse this provisional credit. You expressly consent to this reversal if you falsely or incorrectly dispute a charge.

In the event that AAA charges any convenience fee for making a payment via a credit card, these fees will be stated at the time of payment before you finalize your charge. In the event of an unauthorized charge using a debit card or electronic check, please consult your bank’s rules regarding refunds and reversals. AAA complies with all legal requirements regarding unauthorized charges. When you make a charge, AAA shall display a completed charge screen. This is your electronic receipt. You should print or save this electronic receipt for your records. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S), DEBIT CARD(S) OR OTHER PAYMENT MEANS USED TO INITIATE ANY TRANSACTION.

Fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you are responsible for payment of all such taxes, levies or duties. Any amounts not paid when due may bear interest at the rate set forth in the applicable policy or account. If the interest rate is not made available to you, then AAA reserves the right to charge a reasonable interest rate, including up to the maximum legal rate. If any fee cannot be charged to your credit card for any reason, AAA may provide you, via email, notice of such non-payment and a link for you to update your payment information. If such non-payment is not remedied within seven (7) days after receiving such notice of non-payment, then AAA may terminate the applicable Service, in accordance with the applicable policy or account.

Consent to Communications

By accepting these Terms, you are providing express permission and consent authorizing us or our agents to contact you at any phone number (including mobile, cellular, wireless, or similar devices) or email address you provide at any time, for any lawful purpose. The ways which we may contact you include live operator, automatic telephone dialing systems (auto-dialer), prerecorded message, text/SMS messages or email. Such lawful purposes include, but are not limited to: obtaining information; providing service updates; activation of the card for verification and identification purposes; account transactions or servicing related matters; suspected fraud or identity theft; collection on the account; and providing information about special products and services. You agree to pay any fee(s) or charge(s) that you may incur for incoming communications from us or outgoing communications to us, to or from any such number or email address, without reimbursement from us. If you prefer not to be contacted in one or more of these ways, you must either call us at 800-922-8228 or write to us at AAA, 1277 Treat Boulevard, Suite 1000, Walnut Creek, CA 94597, and include your name, address, phone number, Account number, and whether you would like communications to cease via mail, telephone number(s), email, text/SMS, or cease in all forms.

Termination

AAA reserves the right, in its sole discretion and without prior notice, to terminate your access to the Sites or Services for any reason, including a breach of these Terms or the law. Company will not have any liability whatsoever to you for any termination of your access to the Sites or Services.

Copyright Policy

AAA respects the intellectual property of others and asks that users of our Sites and Services do the same. In connection with our Sites and Services, we have adopted and implemented a policy respecting copyright law that provides for the removal of any infringing materials and for the termination, in appropriate circumstances, of users of our online Sites and Services who are repeat infringers of intellectual property rights, including copyrights. If you believe that one of our users is, through the use of our Sites and Services, unlawfully infringing the copyright(s) in a work, and wish to have the allegedly infringing material removed, the following information in the form of a written notification (pursuant to 17 U.S.C. § 512(c)) must be provided to our designated Copyright Agent:

  1. your physical or electronic signature;
  2. identification of the copyrighted work(s) that you claim to have been infringed;
  3. identification of the material on our services that you claim is infringing and that you request us to remove;
  4. sufficient information to permit us to locate such material;
  5. your address, telephone number, and e-mail address;
  6. a statement that you have a good faith belief that use of the objectionable material is not authorized by the copyright owner, its agent, or under the law; and
  7. a statement that the information in the notification is accurate, and under penalty of perjury, that you are either the owner of the copyright that has allegedly been infringed or that you are authorized to act on behalf of the copyright owner.

Please note that, pursuant to 17 U.S.C. § 512(f), any misrepresentation of material fact (falsities) in a written notification automatically subjects the complaining party to liability for any damages, costs and attorney’s fees incurred by us in connection with the written notification and allegation of copyright infringement. Dispute Resolution and Arbitration Agreement

PLEASE READ THIS PROVISION OF THE TERMS CAREFULLY.

Informal Dispute Resolution

With the significant costs arising from legal disputes, not only in dollars but also in time and energy, both you and AAA agree to the following dispute resolution procedure: In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the Sites, or the breach, enforcement, interpretation, or validity of these Terms or the Membership Terms and Conditions or any part the documents (“Dispute”), the party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party (by first class or registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute (“Dispute Notice”) and allowing the receiving party 30 days in which to respond to or settle the Dispute. Dispute Notices shall be sent:

To you at: your last-used billing address.

You and AAA agree to make a good-faith effort to resolve the dispute for at least 60 days (the “Negotiation Period”) following receipt of a Dispute Notice.  If the sufficiency of a Dispute Notice or compliance with this mandatory pre-dispute resolution process described in this section is at issue, it may be decided by a court of competent jurisdiction at either party’s election, and any formal dispute resolution proceeding will be stayed. Such court has the authority to enforce this condition precedent to an arbitration proceeding, which includes the power to enjoin the filing or prosecution of a demand for arbitration. Notwithstanding the foregoing, either party retains the right to raise non-compliance with this condition precedent and seek related damages in arbitration.  

Any applicable limitations period (including statutes of limitations) and any filing fee deadlines will be tolled while you and the AAA are engaged in the mandatory pre-dispute resolution process. 

Arbitration Agreement

To the extent you and AAA cannot resolve any Dispute during the Negotiation Period through the informal dispute resolution procedure described above, YOU AND AAA AGREE, TO THE FULLEST EXTENT PERMITTED BY LAW, TO USE ARBITRATION, NOT LAWSUITS (except for small claims court cases, described below) TO RESOLVE THE DISPUTE.  Arbitration replaces the right to go to court, have a jury trial or initiate or participate in a class action. In arbitration, disputes are resolved by an arbitrator, not a judge or jury. This section is made pursuant to a transaction involving interstate commerce, shall be governed by the Federal Arbitration Act (FAA), and shall be interpreted in the broadest way the law will allow.

A. Covered Claims

You and AAA agree that we shall arbitrate any claim, dispute, or controversy between you and AAA arising out of or related to your current or previous membership, or these Terms (“Claims”). Neither you nor AAA will have the right to litigate Claims in court or have a jury trial on any Claims.  You and AAA agree that the sole and exclusive forum and remedy for any and all disputes that cannot be resolved informally will be final and binding arbitration conducted in accordance with this section.

Except as set forth below, all Claims are subject to arbitration, no matter what legal theory they are based on or what remedy (damages, or injunctive or declaratory relief) they seek, including Claims based on contract, tort (including intentional tort), fraud, agency, your or our negligence, statutory or regulatory provisions, or any other sources of law; Claims made as counterclaims, cross-claims, third-party claims, interpleaders or otherwise; Claims made regarding past, present, or future conduct; and Claims made independently or with other Claims. This also includes Claims made by or against anyone connected with us or you or claiming through us or you, or by someone making a claim through us or you, such as an agent, representative, third party vendor or an affiliated/parent/subsidiary company.

The demand for arbitration must be personally signed by the party initiating arbitration (and their counsel, if represented). By signing the demand for arbitration, a party (and their counsel, if represented) certify that they have complied with (i) the mandatory pre-dispute resolution process; (ii) all of the requirements of Federal Rule of Civil Procedure 11(b), including that the claims and relief sought are neither frivolous nor brought for an improper purpose.  The arbitrator is authorized to award any relief or impose any sanctions available under Federal Rule of Civil Procedure 11 or applicable federal or state law against all appropriate persons (including counsel) as a court would.

B. Arbitration Limits

Individual Claims filed in a small claims court are not subject to arbitration, as long as the matter remains in small claims court.

If you assert a Claim against us, we will arbitrate all actions, including actions to collect a debt from you. You will also be obligated to arbitrate on an individual basis Claims brought against you, including Claims to collect a debt.

Claims brought as part of a class action, private attorney general or other representative action can be arbitrated only on an individual basis. The arbitrator has no authority to arbitrate any Claim on a class or representative basis and may award relief only on an individual basis. If arbitration is chosen by any party, then neither you or AAA may pursue a Claim as part of a class action or other representative action. Claims of two (2) or more persons may not be combined in the same arbitration.

C. Administration

The arbitration shall be administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures and its Mass Arbitration Procedures and Guidelines, if applicable, in effect at the time the arbitration is commenced. The arbitration shall be conducted before a single neutral arbitrator. The seat of the arbitration shall be Contra Costa County, California. The language of the arbitration shall be English. The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could have awarded in the absence of this agreement to arbitrate. Any award by an arbitrator shall be binding and final. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.  

If a court or arbitrator determines that any part of this arbitration agreement other than the Waiver of Right to Bring Class Actions is not enforceable, the rest of this arbitration agreement will be enforceable.  Except as otherwise set forth in these Terms, any and all issues relating or pertaining to arbitration or this arbitration clause, including but not limited to the threshold question of arbitrability or the enforceability or validity of this arbitration clause, shall be delegated to the arbitrator selected pursuant to this provision. I understand that the arbitrator’s decision will be final and binding, and that other rights I may have if I went to court may not be available in arbitration.

D. Arbitration Fees and Costs

AAA will pay, or reimburse you for, all costs and fees paid to the arbitration Administrator to the extent required by law or the rules of the arbitration Administrator. Each party will bear the expense of that party’s attorneys, experts, and witnesses, and other expenses, regardless of which party prevails, except that (a) the arbitrator shall apply any applicable law in determining whether a party should recover any or all expenses from another party, (b) the arbitrator shall require you to pay us collection costs and attorneys’ fees, including our in-house attorneys’ costs, that we incur in connection with any Claims brought against you to collect a debt, and (c) the arbitrator may assess attorneys’ fees and costs against a party upon a showing by the other party that the first party’s claim(s) or conduct was frivolous or pursued in bad faith or solely for purpose of multiplying the arbitration proceedings unreasonably or vexatiously.

E. Waiver of Right to Bring Class Actions and Representative Claims

You and AAA agree that all arbitrations shall proceed on an individual basis, and not on a consolidated, representative or collective action basis. You and AAA may not be plaintiffs or class members in any purported class, collective, or representative proceeding. The arbitrator is empowered to resolve the Dispute with the same remedies available in court, however, any relief must be individualized to you and shall not affect any other customer. You and AAA agree that each may bring claims against the other in arbitration only in your or their respective individual capacities and in so doing you and AAA hereby waive the right to a trial by jury, to assert or participate in a class action lawsuit or class action arbitration (either as a named-plaintiff or class member), and to assert or participate in any joint or consolidated lawsuit or joint or consolidated arbitration of any kind. If a court decides that applicable law precludes enforcement of any of this paragraph's limitations as to a particular cause of action, then that cause of action (and only that cause of action) must remain in court and be severed from any arbitration.

F. Miscellaneous

These Terms shall be governed by the laws of the State of California without giving effect to any conflict of laws principles that may require the application of the law of another jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Notwithstanding the foregoing, AAA will have the right to seek preliminary injunctive relief immediately and without first going through the arbitration process set forth above to protect its intellectual property or confidential or proprietary information.

Unless it is submitted to arbitration as set forth above, any other dispute must be brought in a federal or state court located in Contra Costa County, California, and each party irrevocably submits to the exclusive jurisdiction and venue of any such court in any such action or proceeding.

Use of our Sites is not permitted in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this paragraph. The provisions of these Terms will be deemed severable, and the unenforceability of any one or more provisions will not affect the enforceability of any other provision. In addition, if any provision of these Terms, for any reason, is declared to be unenforceable, the parties will substitute an enforceable provision that, to the maximum extent possible under applicable law, preserves the original intentions and economic positions of the parties.

Any failure on our part to enforce any of our rights under the Terms or applicable laws shall not constitute a waiver of such right.

You may not assign or transfer these Terms or your rights or obligations under these Terms without the prior written consent of AAA, and any assignment or transfer in violation of this provision shall be null and void. There are no third-party beneficiaries to these Terms.

No joint venture, partnership, employment, or agency relationship exists between you and us as a result of your use of the Sites.

Our performance under these Terms is subject to existing laws and legal process. We will comply with law enforcement requests or requirements relating to your use of the Sites or information provided to or gathered by AAA with respect to such use.

The Terms (together with any additional terms applicable to specific Services you use including our Privacy Policy) constitute the entire agreement between you and us with respect to our Sites and Services. They supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and us with respect to our Sites and Services. In the event of a conflict between these Terms and any other applicable terms applicable to specific Services you use, those other applicable terms shall control.

A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
