AAA Member Story Release
I hereby acknowledge that I am providing AAA Northern California, Nevada & Utah, its affiliates and parent companies (individually and collectively “AAA NCNU”) with a written or recorded submission pertaining to my personal AAA Membership experience and understand that AAA may (but is not obligated to) ask me to participate in further interview(s) and/or be recorded by AAA NCNU (collectively, the “Interview”) in connection with my AAA Membership experience, which may include providing details about my experiences, incidents, dialogues, actions, and recollections. The written submission I am now providing, as well as any written materials, videos, photographs, recordings, documents and other content/materials that I provide to AAA NCNU as part of the Interview or otherwise, are all referred to as the “Work” in this Member Story Release.
I hereby grant AAA NCNU the absolute and irrevocable right and permission to (i) quote, paraphrase, reproduce, publish, distribute, perform, display, creative derivative works from, or otherwise use or exploit any portion of the Work and/or the Interview; and (ii) exploit my name, city/state of residence, appearance, signature, characteristics, biographical material, photograph, portrayal, image and/or actual or simulated likeness (collectively, “Likeness”) – all for marketing, advertising, promotional, trade or any other purpose, in all forms and in all media throughout the world and in perpetuity. In the event that any part of my Interview or other interactions with AAA NCNU are recorded, transcribed, or otherwise documented by AAA NCNU or its representatives (any a “Recording”), I assign to AAA NCNU any and all right, title, or interest I may have in the Recording(s), if any. I hereby waive any right I may have to inspect or approve the use of my Work, my Likeness, and any Recording.
I represent and warrant that I have the right to grant AAA NCNU all of the rights set forth above without obtaining the permission of, or making any payments to, any third party or entity. I confirm that, to the best of my knowledge, any statements made by me in the Work, Recording(s) or Interview will not violate or infringe upon any third party's rights. I represent and warrant that any statements made by me in the Work, Recording(s), or Interview will reflect my honest opinions, findings, beliefs, or experiences with AAA NCNU’s products and services, and I shall notify AAA NCNU immediately in writing if any of my statements no longer reflect my honest opinions, findings, beliefs, or experiences. I further represent and warrant that I am at least eighteen (18) years of age and am the age of majority in the jurisdiction in which I reside, and that I have the full, complete, and unrestricted right and authority to enter into this Member Story Release.
I hereby release and discharge AAA NCNU and its licensees, successors, and assigns and each of their respective officers, directors, shareholders, and employees thereof (“Released Parties”) from any and all claims, demands, or causes of action that I may have against them regarding any use of the Work or the Interview in accordance with the rights granted by me pursuant to this agreement, including (but not limited to) any claims based on the right to privacy, the right of publicity, copyright, defamation, or any other right. I hereby waive any morals rights I may have in the Work, the Interview, any Recording(s) and/or my Likeness.
This Member Story Release shall be governed by, and construed in accordance with, the laws of the State of California, and any dispute shall be brought in the federal or state courts located in San Francisco, California.
AAA NCNU may freely assign its rights and obligations hereunder as it deems appropriate. This Member Story Release constitutes the entire understanding and agreement with respect to the subject matter hereof and cannot be amended except by a written instrument signed by the parties hereto. This Member Story Release will inure to the benefit of and will be binding upon our respective affiliates, successors, licensees, assigns, heirs, and representatives.
